As an independent businessman, I am free to spend my time as I want. Unlike most attorneys, I do not need to bill for every waking hour of the day to make a living. I enjoy the time and freedom to learn new things, to start businesses, to travel, and to take risks. There is no substitute for the knowledge and skill one gains by doing something he loves to do. My passion is making deals and making money! I love building things, solving problems and finding new ways to deliver goods and services - quicker, faster and cheaper. I know how to represent business people because I have been one my entire life. I understand the concerns and needs of investors and entrepreneurs because I have made the lion's share of my wealth and income by taking risks and by putting my money where my mouth is.
Over the years, I have accumulated an invaluable amount of experience, skill, and confidence in starting up and managing successful businesses and real estate ventures. I am a hands-on, detailed-oriented, proactive person.I know how to get results! How to complete difficult tasks! Most important of all, I know how to make money!
Traditional Lawyers Are Not Effective!
Studies show that 85% of judgments go uncollected! That means that 85% of successful lawsuits result in no money or measurable benefit for the winning party! The vast majority of judgments that are collected usually involve an insurance company.
Where does that leave the entrepreneur or small business owner who wants to protect his interests? In my opinion, the average business owner is grossly underserved.
Most lawyers offer their clients worthless boilerplate advice, plagiarized agreements and a false sense of protection. Wearing a nice suit, occupying an office with a prestigious address, having the ability to write well and debate ideas in a courtroom may be impressive and appear very sophisticated but, looks are deceiving. None of those qualities are of any meaningful value to the vast majority of business people. Business owners need information! They need cost effective and creative techniques to build their business, to protect their assets, to assure they will be paid for their goods and services and to deal with difficult and often dishonest people. No one is going to decide to do business with you because your lawyer has a Park Avenue address! No one cares that your lawyer went to an Ivy League school when they are deciding to lend you money, pay an outstanding invoice, or invest in your company. The obsession with appearances is utter nonsense and ultimately it will never lead to long-term success. To add insult to injury, ordinary corporate structures, dependency on contracts and the potential threat of litigation are no longer a sufficient, effective, or affordable option to protect your rights. A lawyer whose experience begins and ends at the courthouse steps or in the conference rooms of a large corporate law firm is more likely to hurt you than help you.
Traditional lawyers fall into one of two camps - They are either “litigators” or “drinking buddies.” Generally, “litigators” are nasty, phony, “want to be tough guys” whose knowledge of the law is limited to civil procedure. Most of them spent the majority of their time shaking down insurance companies. The truth is insurance companies understand that sooner or later they have an obligation to pay legitimate claims. (Otherwise, regulators will put them out of business.) Understanding this, litigators and the attorneys for the insurance companies play a game of keeping lawsuits in the system long enough for the insurance company to budget for the settlement. Very few cases actually go to trial. Litigators get their work by telling prospective clients what they want to hear. And, sooner or later they take on the persona of a mafia don. It’s all bark and no bite. When a insurance company is not involved in a case, as in most commercial disputes, most litigators are not equip to give meaningful advise on substantive issues nor, do they have the knowledge or skill needed to litigate a case when there is no definitive payday on the horizon. They’re paper tigers! They just know how to file lawsuits. Now consider the fact that 85% of judgments are never collected. How effective are these people - really? Even when they win, the businessmen paying them lose. It’s a waste of time and money.
In contrast, “drinking buddies” are nice guys who provide boilerplate advice. They form corporations, prepare tax returns, draft agreements and apply for licenses. They don’t have an original thought in their head. And, God forbid their clients are ever sued and they’re asked for any meaningful advice. 99 times out of 100, these guys don’t have a clue on how to effectively handle a crisis or how to deal with dishonest people in a constructive way. As smart as some of these attorneys may be, they are completely useless in a crisis.
Academically, traditional lawyers may be "brilliant" however, they lack the experience needed to avoid or solve problems. Most attorneys start their career in a large firm or working for a judge where everything is a “team effort.” In this environment, problems are dealt with from a distance and individuals are rarely held accountable. For these attorneys, success is often measured by the number of billable hours accounted for in a given period, not on the value of their advice or the results their clients experience.
THE BOTTOM LINE IT'S ALL ABOUT THEM AND HOW MUCH MONEY THEY MAKE!
Most lawyers could care less about their clients. Clients are literally looked upon as a business commodity.
Ultimately, you cannot fix problems from behind a desk. You need to be where the rubber meets the road! You need someone who is willing to leave his office and get his hands dirty in order to learn and truly understand the dynamics of the problems he is hired to fix or the business he is hired to represent. You need someone who is willing to be held accountable. You need someone who is results oriented. Traditional lawyers are not willing or able to work this way!

Billionaire Warren Buffet is famous for saying, "A good businessman is an investor, and a good investor is a businessman." I agree with this sentiment. I offer you my own version, "A good attorney must think like a businessman, and a good businessman must think like an attorney."
We live in a very tough world. A handshake and man's word isn't what it used to be. The legal system is broken and law enforcement is often a crap shoot. Nowadays, people are nasty, dishonest and are far more likely to pay an attorney to get out of paying their bills, than actually paying their bills. Lawsuits are expensive, and often take far too long to truly be useful or just. Instead of encouraging people to innovate and build things, we have a government which is determined to regulate and tax every entrepreneur out of business. Every business owner should have the benefit of a professional who understands these challenges, and who has a wide spectrum of skills to enhance their business.
MOST legal problems can be avoided! MOST agreements can be effectively enforced without litigation!
Operational safeguards, corporate mechanisms and market-based solutions are often far more expedient, cost effective and just than a traditional legal approach which relies entirely on contracts and litigation to solve problems.
